Article 28: Work Contract Requirements

In force

In simple words

Your work contract should be written and include the start date, salary, job type and (if fixed-term) the contract period, in three copies. Even without a written contract you are still protected and can prove your rights in other ways. Your salary cannot be reduced during the contract, and you cannot be given work that doesn’t match your contract or skills.

Example

Salary cut after signing the contract

Situation

Rahim’s contract says 250 KD. After 6 months his manager asks him to sign a new paper accepting 200 KD.

What the law says

The wage cannot be reduced during the contract, and any agreement to reduce it is void. Rahim is still owed 250 KD a month. His employer also cannot move him to work that doesn’t match his contract or qualifications.

Names are made up for illustration.

If the work contract is not prepared in a written document, the contract shall be deemed as prevailing and in this case the labourer shall evidence his rights through all evidencing methods. If the work contract is for a limited or unlimited period, the labourer wage shall not be reduced during the validity of the contract.
