Article 32: Probation Period

In force

In simple words

Probation can last up to 100 working days and must be written in the contract. During probation either side can end the contract without notice, but if the employer ends it, it must pay indemnity for the time worked. You cannot be put on probation twice by the same employer.

Example

Terminated during probation

Situation

Maria is let go after 60 working days of probation.

What the law says

Probation can’t be longer than 100 working days, and either side can end the contract without notice during it. Because the employer ended it, Maria must still receive indemnity for the time she worked. She can’t be put on probation twice by the same employer.

Names are made up for illustration.
