Article 62: Calculation of Dues

In force

In simple words

Your rights (such as indemnity and leave pay) are calculated on your last salary. For piece-rate workers, the average of the last 3 months is used, and bonuses are averaged over the last 12 months. Your salary can never be reduced during your employment.

Example

Which salary is used for indemnity?

Situation

Ravi got a raise from 350 KD to 400 KD two months before leaving.

What the law says

Dues are calculated on the last salary paid, so his indemnity uses 400 KD. Incentives are averaged over the last 12 months.

Names are made up for illustration.

Official text of Article 62
When calculating the labourer's dues, the last salary paid to him shall be considered. If a labourer receives a salary on the basis of piecework, the relevant estimate shall be made on the average wage duly paid to him for the actual working hours during the last three months. The assessment of cash and in-kind incentives shall be made by dividing the average of what is received by the labourer from the salary during the last twelve months into the entitlement. If the term of his service is less than one year, the average shall be computed in accordance with the percentage period spent in the service. A labourer's wage shall not be reduced during the course of his work for any reason whatsoever.
