Article 61: Salaries During Closure

In force

In simple words

If your employer closes the business to pressure workers, or the business is closed for any reason that isn’t the workers’ fault while the employer still wants them to continue, the employer must keep paying full salaries.

Example

Shop closed for renovation

Situation

Ramesh’s shop closes for a month of renovation, and the owner says nobody will be paid.

What the law says

The workers aren’t at fault and the owner wants them back after, so he must pay full salaries for the closure period.

Names are made up for illustration.

Official text of Article 61
The employer shall undertake to pay the salaries of his labourers during the closure period if he intentionally closes the firm in order to force the labourers to submit or surrender to his demands. Also, he shall be obliged to pay the salaries of his labourers for the entire period during which the firm is closed, whether totally or partially, for any other reason which the workers have no hand in it, since the employer would like them to continue to work with him.
