Article 55: Wages Definition

In force

In simple words

Your “wage” includes your basic salary plus everything regularly paid under your contract or company rules, such as allowances, commissions, bonuses and grants. This full amount is used when calculating your rights. The government’s social and children’s allowances for Kuwaitis are not included.

Example

Are allowances part of salary?

Situation

Ahmed gets KD 250 basic, KD 60 housing and KD 20 transport every month. The company calculates his indemnity on KD 250 only.

What the law says

Allowances paid regularly are part of the wage. His indemnity must be calculated on KD 330, not KD 250.

Names are made up for illustration.
