If you’ve ever paid an influencer to promote a restaurant, a clothing brand or a home business on Instagram or Snapchat, this one’s for you. Kuwait has just folded social media advertising into formal media law for the first time, and that changes the ground rules for anyone making money from online promotion here.
It’s part of a much bigger overhaul covered in Kuwait’s new single media law replacing three older ones, but the social media advertising piece deserves its own look because it touches ordinary people, not just newspapers and TV stations.
- Decree-Law No 102 of 2026, the Media Regulation Law, was published in the Official Gazette and comes into force six months later.
- It replaces the 2006 Publications Law, the 2007 Audiovisual Media Law and the 2016 Electronic Media Law.
- For the first time, social media advertising and commercial promotion fall under the same licensing system as newspapers, broadcasters and news sites.
- Unlicensed media activity, including ads, can bring fines and administrative penalties.
Why social media ads specifically?
The law’s explanatory memorandum is fairly direct about this: the digital boom changed how broadcasting, publishing and public influence work, and the old laws simply didn’t see it coming. Nobody was writing rules for paid Instagram posts or TikTok promotions back in 2016 when the electronic media law was passed. Now there’s a framework meant to catch up.
This fits a pattern we’ve already seen building in Kuwait this year, from court cases over social media posts to the deportation of a well-known social media figure. Authorities have clearly decided that online influence and online income need the same oversight as traditional media.
Who actually has to do something?
The law covers a wide range: newspapers, audiovisual broadcasters, technical broadcasting services, electronic news outlets, news agencies, foreign correspondents, cinema and artistic production, plus digital advertising and commercial promotion. If you run a page or account that’s effectively a commercial operation, selling ad space or paid promotions, you’re in scope.
Here’s the timeline as it stands:
- The decree was published in Kuwait Al-Youm, and the six-month countdown to the law taking effect starts from that date.
- Within that same six-month window, the competent minister must issue executive regulations spelling out the technical and procedural details.
- Once those regulations are out, existing media operators, which could include commercial social media advertisers, get another six months to bring their status in line.
- Miss that window and a licence can be revoked.
