Article 45: Leaves

Your employer cannot give you a termination notice while you are on any leave allowed by this law (annual, sick, maternity and so on).

Situation

Aisha receives a termination notice while she is on her annual leave in Manila.

What the law says

The employer cannot use its notice right while the worker is on any leave provided by the law. The notice should only be given after she returns.

Names are made up for illustration.

Official text of Article 45
The employer may not use his right to terminate the contract under the previous Article while the labourer enjoys one of his leaves provided for in this law.
