Article 44: Termination with Notice

In force

In simple words

In an open-ended contract, either side must give written notice to end it: at least 3 months for monthly-paid workers, and at least 1 month for others. Whoever doesn’t give notice must pay salary for the notice period. If the employer gives notice, you can take one paid day (or 8 hours) a week to look for a new job.

Example

Notice period for monthly-paid workers

Situation

Sunil, paid 450 KD a month on an open-ended contract, is told on 1 March that his job ends.

What the law says

A monthly-paid worker must get at least 3 months’ written notice. If the employer ends the job immediately, it must pay 3 months’ salary (1,350 KD) instead. During notice, Sunil can take one paid day (or 8 hours) per week to look for a new job.

Names are made up for illustration.

Official text of Article 44

a) At least three months prior to the termination of the contract, in the event of a monthly salary labourer.
b) At least one month prior to termination; if the contract does not observe notice period, he shall be obliged to pay the other party a notice period amount equal to the labourer's salary for the same period.
c) If the termination notice is made by the employer, the labourer shall have the right to be absent from work for one full day within a week or eight (8) hours during the week in order to search for another job along with his entitlement to his wage for the absent day or hours. The labourer shall have the right to fix the absent day and hours provided that he shall inform the employer at least on the day preceding his absence.
d) The employer may terminate the labourer during the notice period along with calculating the labourer's service term continuously until the expiry of that period, together with the effects arising thereof particularly the labourer's entitlement to his wage for the notice period.
