Article 37: Notification of Punishments

In force

In simple words

Before you are punished, you must be told in writing what you are accused of, and you must be allowed to give your side of the story, which is recorded in your file. Any penalty must also be given in writing, with the reason.

Example

Salary cut without any warning

Situation

Maria finds 2 days’ pay deducted from her salary as a penalty, without ever being told why.

What the law says

Before any penalty she must be told the accusation in writing, heard and allowed to defend herself, and then told the penalty in writing with the reason. A deduction made without this process is not valid.

Names are made up for illustration.
