Court sentenced two expatriate sisters to jail of two years with hard labor

The Court of Appeals has overturned the verdict issued by a lower court which sentenced two expatriate sisters to jail term of two years and four months with hard labor for forgery related cases.

According to the case file, the Public Prosecution accused the two women of forging their residential address such that when a court order was issued against them, the address mentioned in the court files differed from the address in which the two sisters were actually residing.

During the court session, the defense counsel Lawyer Abdulmohsen Al-Qattan explained that his clients had no intention of committing any crime and that there is no criminal basis in their action. Even though they knew that the addresses they had given were not true, the case lacks criminal intent in their action and the law only punishes those who were aware of their action and had criminal intent behind it, which his clients lacked.

The Court of Appeals presided over by Judge Nasser Salem Al-Haid cancelled the verdict issued by the Criminal Court and sentenced a Kuwaiti citizen to jail term of two years and eight months with hard labor for hitting his relative and insulting him outside his house during an argument over a family dispute. Even though the defendant had denied all accusations, the plaintiff provided records of the CCTV camera that was installed outside the house. He also presented a medical report which indicated the injuries he sustained throughout his body including a painful nose injury.

The Criminal Court had sentenced the defendant to two-year imprisonment for hitting the plaintiff and imposed a fine of KD 50 for insulting the plaintiff. It also decided to suspend the execution of the verdict for three years, provided the defendant upholds good conduct during this period. It released him on bail worth KD 500. However, the defendant appealed against this verdict at the Court of Appeals and demanded to be acquitted while the plaintiff counsel insisted that the defendant should be penalized.
